Vicarious violence constitutes one of the most complex manifestations of gender-based violence, characterized by harm inflicted upon children or other individuals with close emotional ties to the victim as a means of causing psychological and emotional suffering. Although this phenomenon has gained increasing recognition at the international level, Colombia still faces legal gaps that hinder its autonomous recognition, judicial enforcement, and comprehensive compensation, thereby limiting the effective protection of victims' rights. This article aims to analyze the existing legal gaps in the treatment of vicarious violence in Colombia from an inclusive gender perspective. To this end, a qualitative study with a descriptive and analytical scope was conducted, based on a documentary review of national and international legislation, case law, legal doctrine, and previous research related to vicarious violence and the protection of human rights. The findings reveal that the current Colombian legal framework is insufficient to address this form of violence comprehensively and highlight the need to strengthen its legal recognition, judicial mechanisms, and comprehensive reparation measures. It is concluded that adopting an inclusive gender perspective promotes a more effective legal response aimed at guaranteeing the protection of all victims and ensuring effective access to justice.
